These Terms of Service ("Terms") govern the y2k: 2000s photo editor mobile application, website, and related services (together, the "Services") operated by Brick and Yarn, LLC ("Y2K," "we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

These Terms are not a promise that every catalog asset is cleared for every use. The asset-license rules in Section 5 are important, especially for commercial projects.

1. Eligibility and authority

You must be at least 13 years old to use the Services. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you. If you use the Services for a business or organization, you represent that you can bind that entity to these Terms.

2. The Services and your app license

Y2K provides tools for editing photos and videos, including filters, text, collages, stickers, and export features. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the App on devices you own or control.

Apps distributed through Apple are licensed, not sold. Apple's Licensed Application End User License Agreement also applies unless a valid custom EULA is provided through the App Store. Apple's terms control the App Store license where they conflict with this Section.

3. Your photos, videos, and creations

You retain your rights in photos, videos, text, and other material you import or create ("Your Content"). The App's editing workflow processes imported media on your device and does not upload that media to Y2K for editing. You choose whether to save or share an output.

You are responsible for Your Content and must have the rights and permissions needed to use it. You may not use the Services to infringe intellectual-property, privacy, publicity, or other rights, or to break the law. If you voluntarily send content to support or a reporting channel, you authorize us to use it only as reasonably necessary to investigate, respond, enforce these Terms, and comply with law.

4. Y2K software and ownership

The App, website, interfaces, software, branding, and Y2K-created materials are owned by Y2K or its licensors and are protected by intellectual-property laws. Except for the limited licenses expressly granted in these Terms, no rights are transferred to you.

You may not reverse engineer, copy, sell, rent, sublicense, scrape, or redistribute the Services except where applicable law does not permit that restriction.

5. Stickers, filters, and commercial use

Y2K selects and publishes the catalog, which includes free stickers and premium sticker packs. Free or premium describes how you access an item; it does not transfer ownership or by itself grant commercial-use rights. The license limits below apply to both free and premium App Content.

Y2K's editing tools may be used to create personal or commercial projects using Your Content. Catalog stickers, filters, templates, fonts, and other supplied visual material ("App Content") have separate license limits.

Unless a specific item is expressly marked "Commercial Use" in the App or is accompanied by a separate commercial license, App Content is licensed only for personal, non-commercial use in an output created with the App.

Even when commercial use is expressly allowed, you may not extract, resell, redistribute, sublicense, or offer App Content as a standalone asset or stock item; use it as a trademark or logo; claim ownership of it; or use it in an unlawful, defamatory, deceptive, or rights-violating way. Rights in third-party names, likenesses, brands, and works remain with their owners. Availability in the App does not imply endorsement.

6. y2k plus subscriptions, trials, cancellation, and refunds

Y2K offers optional auto-renewable subscriptions called "y2k plus." The price, billing period, included features, and any introductory offer displayed by the store where you subscribe control your purchase. Apple processes App Store purchases; Google processes Google Play purchases.

  • An eligible free trial converts to the displayed paid subscription unless you cancel before the trial ends. Subscriptions renew for the displayed billing period until canceled.
  • For App Store purchases, manage or cancel in your Apple Account subscription settings. Apple may begin renewal processing during the final 24 hours; cancel at least 24 hours before the trial or current billing period ends to avoid renewal.
  • For Google Play purchases, manage or cancel in Google Play's Payments & subscriptions settings using the Google Account that made the purchase. Cancel before the next billing period or trial ends to avoid the next subscription charge.
  • Deleting the App does not cancel a subscription. Cancellation normally takes effect at the end of the current paid period, subject to the applicable store's terms and mandatory consumer rights.
  • Request refunds through the store where you purchased. Its refund rules and any non-waivable consumer rights apply.
7. Acceptable use and safety

You may not use the Services to create, promote, or distribute:

  • illegal content or instructions for illegal conduct;
  • child sexual exploitation or abuse material;
  • non-consensual intimate imagery, sexual exploitation, or sextortion;
  • credible threats, stalking, harassment, hateful conduct, or terrorism;
  • content that encourages suicide, self-harm, or dangerous conduct;
  • fraud, impersonation, malicious deception, malware, or spam; or
  • content that infringes intellectual-property, privacy, or publicity rights.

We may limit features, remove catalog material, or terminate access when reasonably necessary to protect users, rights holders, Y2K, or the public, or to comply with law.

8. Catalog reports and urgent safety issues

This release provides a catalog selected and published by Y2K. It does not provide end-user accounts or public sticker submissions. Creating or saving a private custom sticker on your device does not publish it to the catalog or make it available to other Y2K users.

The in-App reporting tool lets you identify a catalog sticker and select a safety, privacy, or intellectual-property concern. It does not ask you to upload the sticker. Choosing Other problem is optional. If you choose it, the reporting flow requires a brief explanation of 1–500 characters. Do not include sensitive, private, financial, medical, account, or contact information. A report does not guarantee a particular outcome, but we may investigate and take appropriate action. If the reporting service is unavailable, email [email protected].

Do not download, copy, or email suspected child sexual abuse material. Identify the sticker and its location instead. If someone may be in immediate danger, contact local emergency services. A future public UGC feature will require additional community, moderation, and contributor terms before launch.

9. Copyright and other rights complaints

Send written copyright notices to [email protected]. Our Copyright & IP Notices page explains the required information and how we review complaints. An in-App catalog report alerts us to a concern but normally lacks the contact information, statements, and signature needed for a formal notice.

We review the substance of notices, may seek missing information, and may remove or disable material while addressing a complaint. We may share relevant notice information with the responsible content provider and professional advisers as described in our Privacy Policy. Knowingly making a material misrepresentation in a copyright notice can have legal consequences. Our registered designated agent's mailing address, telephone number, and email address are published on the Copyright & IP Notices page.

Trademark, privacy, publicity, impersonation, and safety concerns have different requirements. Use the in-App reporting tool or contact [email protected] and identify the material and concern. You do not need to claim copyright ownership to report a privacy or safety issue.

10. Third-party services and links

The Services rely on third parties such as Apple and Google Play for distribution and billing, Google Firebase for analytics and some asset delivery, Cloudflare for content delivery and report intake, Bunny.net for content delivery, Supabase for catalog and report records and staff authentication, and Vercel for website hosting and analytics. Their services are governed by their own terms and privacy notices. We are not responsible for third-party sites or destinations you choose through your device's sharing controls.

11. Service changes and termination

We may update, suspend, replace, or discontinue features or catalog material. We may terminate your license if you materially breach these Terms. Sections that by their nature should survive termination, including ownership, disclaimers, liability limits, and dispute terms, will survive.

12. Disclaimers

To the maximum extent permitted by law, the Services and App Content are provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. We do not warrant that every asset is suitable for every project, territory, audience, or platform. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by law, Y2K and its members, personnel, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or business interruption arising from the Services. Y2K's aggregate liability for claims relating to the Services will not exceed the greater of the amount you paid for Y2K through the applicable app store in the 12 months before the claim or US$100. These limits do not apply where prohibited by law, including liability that cannot be limited for fraud, willful misconduct, death, or personal injury.

14. Indemnity

To the extent permitted by law, you will defend and indemnify Y2K from third-party claims, damages, and reasonable costs arising from Your Content, your commercial use of an output, your violation of another person's rights, or your material breach of these Terms. This Section does not apply to the extent a claim was caused by Y2K's own unlawful conduct or where consumer law does not permit it.

15. Governing law and consumer rights

These Terms are governed by Michigan law, without regard to conflict-of-law rules. Courts located in Michigan will have jurisdiction except where non-waivable law allows you to bring a claim elsewhere. If you are a consumer, nothing in these Terms limits mandatory protections available where you live.

16. Changes, assignment, and general terms

We may update these Terms prospectively. We will post a new effective date and provide additional notice when required. If you do not agree to revised Terms, stop using the Services. You may not assign these Terms without our consent; we may assign them as part of a merger, reorganization, financing, or sale. If any provision is unenforceable, the rest remains effective. Failure to enforce a provision is not a waiver. These Terms, incorporated policies, and applicable App Store terms are the entire agreement about the Services.
